A Sacred Site Disrespected

The only road to access it was removed by the railroad with permission from the water company — cutting off vehicle access and isolating the land.

Later, a recreational trail was constructed directly over the cemetery’s private property — without notice to the family or regard for its historical and sacred significance — leading to:

  • Severe erosion damaging the historic grounds and grave areas

  • Mud and runoff flooding parts of the cemetery due to poor slope design

  • Destruction of native wildlife paths and habitat

  • Chemicals sprayed near the site, affecting plant and animal life

  • A lack of respect from some trail users who treat the area as a shortcut, not sacred ground

  • Vandalism and damage increasing due to higher foot traffic

  • Ineffective fencing added after complaints — too narrow and easily bypassed by bikers and pedestrians

  • No clear accountability or preservation effort from those responsible for the trail

But Despain Cemetery — a historic family burial ground in St. Joseph, Missouri (Buchanan County) — continues to be disrespected, isolated, and damaged.

I am writing to express my concern about the ongoing issues affecting Despain Cemetery, a private historic family cemetery located in St. Joseph, Missouri (Buchanan County).

Some time ago, the only access road to the cemetery was removed by the railroad, reportedly with permission from the water company. This action has left the cemetery without proper access for family members, caretakers, or preservation efforts.

Subsequently, a recreational trail was constructed that crosses directly over private cemetery land. This was done without advance notice to the family, and with no accommodations made to protect the site’s historical or cultural significance.

Since the trail was installed, the cemetery has experienced:

- Erosion impacting burial areas  
- Runoff and mud covering parts of the cemetery  
- Increased foot and bicycle traffic leading to damage  
- Disruption to the natural environment and wildlife in the area  

These are serious concerns affecting not just private property but also local history, land use, and environmental integrity. The cemetery is a resting place for generations of a local family, and it should be treated with dignity and protection.

I am respectfully asking the City of St. Joseph to:

1. Clarify how the trail project was allowed to pass through private property  
2. Take steps to restore safe and appropriate access to the land  
3. Consider environmental and cultural preservation in future actions related to the site
